The actions you take in the hours and days after a car accident have a direct impact on your ability to recover fair compensation. Here’s exactly what I’d tell any client who calls me right after a crash.

Get Medical Attention — Even If You Feel Fine

Whiplash, concussions, and internal injuries don’t always hurt immediately. Adrenaline masks pain. See a doctor the same day — and make sure your visit is documented. Gaps in medical care are the first thing insurers use to dispute the severity of your injuries.

Call 911 and Get a Police Report

An official police report is one of the most important documents in a car accident claim. Make sure the responding officer documents the scene accurately — and request the report number before leaving. If the other driver’s account differs from yours, note that clearly.

Document the Scene Thoroughly

Photographs of both vehicles from every angle, the road conditions, skid marks, traffic signals, street signs, and your visible injuries. The more you capture right there, the less room there is for the other side to dispute what happened.

Exchange Information With the Other Driver

Full name, license number, insurance company and policy number, vehicle registration, and phone number. If there are passengers, note how many. Stay calm — don’t argue fault at the scene.

Get Witness Contact Information

Other drivers, pedestrians, anyone nearby who saw the crash. An independent witness account carries significant weight — especially in cases where fault is disputed by the other driver’s insurer.

Don’t Give a Recorded Statement to Any Insurer

Both the other driver’s insurance and your own will likely ask for a recorded statement. You are not required to provide one without legal counsel — and what you say can and will be used to limit what you receive. Call us before you call them back.

The other driver’s insurance already contacted me. What should I do?
Don’t give a recorded statement, don’t agree to anything, and don’t accept a payment — no matter how reasonable it sounds. The adjuster’s job is to close your claim for as little as possible. Call us before you call them back. We’ll handle all communications with the insurance company on your behalf from that point forward.
What if I was partly at fault for the accident?
In most states where we practice, you can still recover compensation even if you shared some responsibility for the crash. Under comparative negligence rules, your recovery is reduced by your percentage of fault — but not eliminated. Florida, California, and most of our licensed states follow some form of this rule. Don’t assume partial fault ends your claim. Let us assess it properly.
My injuries seemed minor at first but have gotten worse. Is it too late to file?
Not necessarily. The statute of limitations for car accident claims is generally two years from the date of the accident in most states where we practice — though Florida recently changed to two years as well. What if the other driver had no insurance?
Your own uninsured/underinsured motorist (UM/UIM) coverage exists precisely for this situation. Uninsured driver claims have specific procedures — having an attorney from the start ensures nothing gets missed.
How long will my car accident case take?
It depends on the complexity of the case and the extent of your injuries. Straightforward cases with clear liability can sometimes resolve in a few months. Cases involving serious injuries, disputed fault, or uncooperative insurers can take longer. What I always tell clients: we don’t settle until we know the full picture of your damages. A fast settlement is rarely the right one.
The insurance company offered me a settlement. Should I take it?
Please don’t sign anything before speaking with an attorney. First offers are almost always significantly below what the case is actually worth — especially if your injuries are still developing. Once you accept a settlement and sign the release, that case is permanently closed. There is no going back for more, regardless of how your condition changes. Let us evaluate the offer first.
